Becoming a finance broker

Eligibility
You do not need a licence to engage in finance/mortgage broking. However, you are prohibited from engaging in finance/mortgage broking if you are:
Disqualification
Some individuals or corporations are disqualified from engaging in finance/mortgage broking and need to obtain
permission from the Business Licensing Authority to engage in finance/mortgage broking. You are disqualified if you have:
  • Been found guilty in the last ten years of an offence:
    • involving fraud, dishonesty, drug trafficking or violence;
    • under Victorian or interstate credit legislation; or,
    • against the Finance Brokers Act 1969, or a similar Act interstate;
  • Had your application for a licence or licence renewal under the Finance Brokers Act 1969, or a similar Act interstate, refused in the previous two years; or,
  • Had your licence, registration or permission to run a regulated business suspended, cancelled or subject to disqualification.
Eligibility criteria, including disqualification details, are set out in Part 4A of the Consumer Credit (Victoria) Act 1995. Obtain legal advice if unsure of your eligibility to engage in finance broking.

Exemptions
The only exemption from the provisions of the Act that relate to finance / mortgage brokers are:


Persons who in association with a bona fide business of supplying land or supplying goods or services negotiates consumer credit for persons who are dealing with the first mentioned person in the course of that bona fide business and do not otherwise negotiate consumer credit, and employees of such a person.
