Disqualification and Permission

Disqualification

Individuals

You are disqualified but can apply, or be invited to apply for permission by the BLA to hold a licence if:

  • within the last 10 years, you have been found guilty of, or convicted for an offence involving fraud, dishonesty, drug trafficking or violence which is punishable by imprisonment for three months or more (whether or not a sentence of imprisonment was imposed)
  • you have had a claim admitted against you from the Victorian Property Fund.

Company

A company must obtain permission from the BLA to hold a licence if:

  • it ceases to have at least one director who is a licensee
  • it or one of it's directors has had a claim allowed against the Victorian Property Fund
  • it has been found guilty of or convicted of an offence involving fraud, dishonesty, drug trafficking or violence which is punishable by imprisonment for 3 months or more
  • one of it's directors is a person who has, within the last 10 years in Australia or elsewhere been convicted or found guilty of any offence involving fraud, dishonesty, drug trafficking or violence which is punishable by imprisonment for 3 months or more (whether or not a sentence of imprisonment was imposed)

Permission

If any of the above factors apply, an individual or company can still apply for, and may be granted a licence.

An individual or company can lodge an application for permission at the same time as their licence application or, the BLA may invite you to lodge an application for permission. Should the BLA invite you to lodge this application, you must lodge it within 30 days of receipt of the BLA's written invitation. 

If any of the above factors apply during the time you already hold a licence, you must apply to the BLA for permission to continue to hold your licence. 

In determining whether or not to grant permission for a licence, the BLA will consider among other things, the type of offence or claim, the events and circumstances that led up to the offence or claim and whether it would be contrary to public interest to grant, or allow you to continue to hold the licence.  

Fees

Individual Permission Application:  $607.90  - no GST payable

Company Permission Application:  $654.60 - no GST payable
