Your Obligations
The Consumer Credit (Victoria) Act 1995, Credit Administration Act 1984, Consumer Credit (Victoria) Code and the Consumer Credit (Victoria) Administration Regulations 2006 are designed to protect members of the public by outlining how credit providers must conduct business.
Failure to comply with the Consumer Credit Code can lead to very large fines and penalties.
Consumer Affairs Victoria provides information to credit providers about their rights and responsibilities. It makes enquiries, responds to complaints about credit providers and can:
- Negotiate an undertaking from a credit provider believed to have repeatedly engaged in unjust conduct. If the credit provider fails to comply with this undertaking, criminal penalties apply
- Prosecute credit providers who do not comply with legal requirements and,
- Bring them before the Victorian Civil and Administrative Tribunal which, among other things, can suspend or cancel registration, and impose a fine or civil penalty.
Trading under different business names
Registrants can only trade under the business name(s) listed on their registration certificate. If you trade under an additional or substitute name you must apply to the Registrar of the BLA for the Register of Credit Providers to be amended.
All business names must be registered with Consumer Affairs Victoria.
