Applying for Second Hand Dealer Registration - Pawnbroker Endorsement

In Victoria, unless exempt, you must be registered with the BLA as a second hand dealer to trade as a second hand dealer.

If you want to carry on business as a pawnbroker your second hand dealer registration must be endorsed by the BLA. You can apply for second hand dealer registration and pawnbroker endorsement at the same time; or if you are already registered as a second hand dealer, you can apply for pawnbroker endorsement at any time.

To register as a second hand dealer and/or have your second hand dealer registration endorsed, so you can act as a pawnbroker, select the appropriate application form from the Online Applications menu.

Exemptions

Under the Second-Hand Dealers and Pawnbrokers Act 1989, the Second Hand Dealers and Pawnbrokers Regulations 2008 and the Second-Hand Dealers and Pawnbrokers (Exemption) Regulations 2008 there are some circumstances where you may not need to be registered as a second hand dealer.

Registration may not be needed if you:

  • Hold a motor car trader's licence under the Motor Car Traders Act 1986 and deal in second-hand motor car parts, as long as you comply with all other provisions of the Second-Hand Dealers and Pawnbrokers Act 1989
  • Deal in goods described in the Schedule of the Second-Hand Dealers and Pawnbrokers (Exemption) Regulations 2008
  • Trade exclusively for charitable or philanthropic or benevolent organisations
  • Are an auctioneer acting in your capacity as an auctioneer
  • Are a licensed firearms dealer within the meaning of the Firearms Act 1996
  • Are conducting a fundraising appeal within the meaning of and as permitted by the Fundraising Appeals Act 1998
  • Are a bank or financier selling goods for the purpose of taking or enforcing securities over those goods.
